child support info in mass i am the dad and when we were divorced the mom went back to NC myself and son stayed in MA, we were married and divorced in NC however no custody order was mad or applied for, its been over 2 years now and after little to no help from the mom i want to file for child support. Can i do this in Massachusetts or does it need to be done where the divorce was made back in NC, also do i need a custody order to get child support? thank you

Since you have been in MA over 6 months, file for it there. Since there wasn't a custody order made, you won't have to transfer anything. Divorce and custody are two different ballgames.

I'm just guessing from experience. But, I believe you need to establish custody. In the mean time, file for temporary child support. Then sue her for custody. Do you know her address and where she works?

I say that because all states have different law Bit I do know divorce is seperate from custody. I do know you have established residency to file in MA. I do you are better off not taking legal advice on a forum, here is a site that has forms and more info. Check this out:
